KickForge is a Canadian business based in New Brunswick, Canada. We provide consulting, coaching, Kickstarter campaign management, marketing support, educational resources, and related services for indie game developers and studios.

You may use the KickForge website for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the website for unlawful, fraudulent, or abusive purposes
• Attempt to gain unauthorized access to the website or its systems
• Interfere with the operation or security of the website
• Copy, reproduce, distribute, or commercially exploit KickForge content without permission
• Use KickForge’s proprietary materials to create a competing service without permission
• Submit content that is unlawful, harmful, misleading, or infringes someone else’s rights

KickForge may modify, suspend, or discontinue parts of the website at any time.

KickForge offers consultations, coaching, educational resources, campaign management, marketing support, and other services described on the website.

The exact services, deliverables, pricing, timelines, and requirements may vary depending on the service purchased.

Certain services may be governed by a separate written service agreement between you and KickForge. Where a separate service agreement applies, that agreement will govern the specific services covered by it.

When working with KickForge, you are responsible for providing accurate and timely information, materials, approvals, feedback, and access reasonably required to provide the agreed services.

You are also responsible for ensuring that information, assets, claims, and other materials you provide to KickForge may lawfully be used for their intended purpose.

Delays in providing required information, materials, approvals, or feedback may affect project timelines and planned launch dates.

Prices for KickForge products and services will be displayed at the time of purchase or provided directly to you. Unless otherwise stated, prices are in the currency indicated at the time of purchase.

KickForge may accept payment through third-party payment providers or by invoice. You agree to provide accurate billing information and pay amounts when due.

For consultations, fees are generally non-refundable once the consultation has taken place.

For digital products, courses, resources, or other self-serve products, refunds may be limited once access has been provided, subject to any rights you may have under applicable law.

For campaign management and other ongoing services, cancellation and payment obligations may be governed by a separate service agreement.

Cancelling, postponing, or otherwise discontinuing a campaign does not by itself create an entitlement to a refund. Where KickForge has already performed services, those services may remain payable even if a campaign is later cancelled, postponed, abandoned, or otherwise does not proceed.

KickForge may provide a refund or other adjustment at its discretion where appropriate.

Nothing in these Terms is intended to limit any cancellation, refund, or other rights that cannot legally be excluded under applicable law.

KickForge provides advice, strategy, marketing support, and campaign management based on our experience and the information available to us.

KickForge does not guarantee that a Kickstarter campaign will reach a particular funding amount, number of backers, conversion rate, revenue level, or other result.

We also do not guarantee:

• Kickstarter approval
• Project We Love selection
• A particular number of followers or backers
• Media, influencer, or streamer coverage
• Advertising performance
• Publisher interest
• Campaign profitability
• The success of a game following its Kickstarter campaign

Campaign performance depends on many factors outside KickForge’s control, including audience response, market conditions, platform decisions, advertising performance, timing, competition, client decisions, and other circumstances.

Any examples, case studies, campaign results, testimonials, or figures shown by KickForge are examples of past results and are not guarantees of future performance.

KickForge may recommend, use, or link to third-party platforms and services, including Kickstarter, Steam, social media platforms, advertising platforms, payment providers, scheduling services, email services, and other tools.

KickForge does not control these third-party platforms and is not responsible for their availability, policies, algorithms, fees, security, decisions, or performance.

Your use of third-party platforms may be subject to their own terms and policies.

Unless otherwise stated, the KickForge website and its content are owned by or licensed to KickForge. This may include website content, templates, educational materials, guides, databases, strategies, frameworks, processes, systems, branding, and other materials provided by KickForge.

You may use materials provided to you by KickForge for your own business or project purposes where they are provided for that purpose.

You may not resell, redistribute, publish, reproduce, share, sublicense, or commercially exploit KickForge’s proprietary materials without written permission.

Client-owned materials remain the property of the client unless otherwise agreed. Nothing in these Terms transfers ownership of KickForge’s underlying methods, templates, systems, frameworks, or intellectual property to a client.

KickForge may receive confidential information about your game, studio, business, campaign, finances, marketing plans, or other activities when providing services. We will generally treat client information as confidential and will not intentionally disclose it except where reasonably necessary to provide services, where required by law, or as otherwise agreed.

Where a separate service agreement contains confidentiality provisions, those provisions will govern the applicable client relationship.

KickForge may publish articles, guides, videos, examples, recommendations, and other educational content. This content is provided for general informational and educational purposes and is not a guarantee of results or professional legal, financial, or accounting advice.

If the website allows comments, testimonials, submissions, or other user-generated content, you remain responsible for the content you submit and must have the necessary rights and permissions to provide it.

By submitting content to KickForge for publication, you grant KickForge permission to use, display, reproduce, and distribute that content for the purpose for which it was submitted, unless otherwise agreed.

KickForge may remove or decline to publish content that is inappropriate, unlawful, misleading, unrelated to the purpose of the website, or otherwise violates applicable website rules.

To the fullest extent permitted by applicable law, KickForge will not be responsible for indirect, incidental, consequential, special, or punitive losses arising from your use of the website or our products and services.

This may include losses relating to:

• Lost revenue or profits
• Lost business opportunities
• Lost data
• Campaign performance
• Platform decisions
• Advertising performance
• Third-party services
• Delays or interruptions outside KickForge’s reasonable control

Nothing in these Terms excludes or limits liability where doing so would not be permitted under applicable law.
